Separation Made Simple: What Happens to Property and Kids When Couples Split

Separation is never easy. It is one of the most stressful times in life, and many people in our Pakenham and surrounding community feel lost when it happens. As a family lawyer working with local families every day, I know the biggest questions people ask are: What happens to our property? and What about the children?

When a couple separates, the law looks at both fairness and practicality. Property settlement is not just about who paid for what. The Court considers the contributions made by both partners, whether financial or non-financial, such as caring for children or looking after the home. It then looks at each person’s future needs. This means things like who will be the main carer of the children, earning capacity, and health are all taken into account. The goal is a fair and reasonable division, not a simple 50–50 split.

When children are involved, their wellbeing always comes first. The law says decisions must be made in the best interests of the child. This covers where they live, how much time they spend with each parent, and how important relationships are supported. Parents are encouraged to agree on arrangements, but when that is not possible, the Court can step in and make orders.

I believe knowledge is power. Too many families wait until things spiral before seeking advice. Understanding your options early can save stress, money, and heartache. At Shawn Mendis Lawyers, our passion is to guide families with clear, practical advice. We cut through the legal jargon so you understand your rights and can move forward with confidence.

If you are facing separation, remember you are not alone. Support is available, and with the right legal advice, you can protect your property, care for your children, and plan for a new chapter in life.
